Do I Have a Personal Injury Claim? And Other FAQs

Posted on 29th July 2017 by RadiateWP in Personal Injury

Simon Law Group answers some of the top questions about personal injury law and related cases.

Do I have a personal injury claim?

Many people wonder what type of injuries are eligible for personal injury claims, and how hurt they have to be to consider filing such a case. When it comes to personal injuries, there are a few things to consider.

You may have a compensable personal injury claim if:

  • ● You were injured to the point of needing to see a doctor
  • ● You lost time at work due to an injury
  • ● Your injury has had an otherwise significant impact on your life

Personal injuries are tricky, especially when occurring aside from an automobile accident. If another party was to blame for this injury, consult with a lawyer to find out your options/legal rights.

What damages can be claimed in a personal injury suit?

There are four main categories of damages that you could file suit for:

  • ● Medical expenses
  • ● Pain and suffering and loss of amenities of life
  • ● Loss of Income
  • ● Disability, disfigurement
  • ● Interest on any or all of these

How long will a personal injury claim take?

Every single case is different. Often, your attorney will recommend waiting a full year after the date of the injury before opening up negotiations, so that you can be sure that your injuries have fully manifested themselves, and you have an accurate picture of what your recovery and long term circumstances might look like.

What is the value of my personal injury claim?

No one can know the resulting value of a personal injury claim until well into the proceedings, after the injuries are fully understood and all the factors related to potential damages have been added up. Again, every single case is different.

What do I need to do for a personal injury claim?

After the initial period of answering questions and filling in details with your attorney, the best thing you can do for your own claim is to keep a careful record of the progress of your health. You can also mark down all your expenses, and attend regular, scheduled meetings with your law firm to keep up-to-date on the proceedings.

Will my personal injury case go to trial?

According to statistics from the US Government, only four or five percent of personal injury cases go all the way to trial, while more than 95% are settled outside of court. So statistically, it is unlikely that your case will go to trial.

All personal injury claims have different details, different stakes, and call for different strategies, as decided by an expert in personal injury law. By working with a law firm that has extensive experience in this practice area, you can be confident that you are giving your case every possible chance.
