Arizona Rules of Family Law Procedure, provides that a judgment under certain circumstances can be set aside, if the motion is filed within a reasonable time and for reasons such as surprise, excusable neglect, newly discovered evidence, fraud, etc. However, the motion must be filed within reasonable time, not more than six months after the judgment/divorce decree was entered. The New Hampshire Supreme Court recently upheld a lower court’s divorce decree and refused to vacate the New Hampshire couple’s 2014 divorce after 24 years of marriage. The New Hampshire couple was married in 1989 and filed for divorce in January, 2014. Their divorce decree was finalized in July, 2014, eight months later in March, 2015, they filed a joint motion to vacate the divorce decree.
