ARKANSAS SUPREME COURT ORAL ARGUMENT ACT 1

The Arkansas Supreme Court  will be hearing Oral Argument  regarding Act 1 which prohibits unmarried couples from fostering or adopting children.   In November, 2008 Arkansas Voters approved by a 57% majority Act 1.

Stephanie Huffman and her partner, Wendy Rickman, have two children but Act 1 prevents them from adopting again.  In April, 2010, a lower court ruled that Act 1 was unconstitutional.  The Trial court judge ruled that the fostering and adopting ban applies to anyone who lives together but are not married.  The Act 1 specifically targeted the gay community.
