Age. For children who are older, a judge may wish to speak with them to determine if the child would prefer to relocate with the primary custodial parent or stay with the non-relocating parent.
Distance. If a parent plans on relocating to a new home that is only a short distance from their old home, the court will more likely grant approval. If a parent wishes to move across the country, they will need to make a very strong case as to how this will improve the welfare of the child.
Quality of Life. The parent must prove to the court that the quality of life will improve by moving. At a minimum, the child must receive an equivalent education as well as similar leisure opportunities in the new location.
